Cigna Denies Cochlear Implant to Disabled Three Year Old Nikki **Speak Up for Justice**

Cigna: Approve coverage for my daughters cochlear implant

My daughter Nicole was born with several health issues. In her first four months of life she had three bowel surgeries, one heart surgery, bacterial meningitis, and we learned that she would need a liver transplant. We also learned that Nikki suffered from undetermined hearing loss, however during that time the doctors and her family was focused on life saving procedures. Nikki is now three years old (almost 4) and she has neuropathy in her left ear and has been pronounced profound deaf in her right ear.

We have been fortunate to be able to send Nikki to the Atlanta Speech School, which has worked wonders with her speech ability. However, her speech pathologist, therapist, teachers, and doctor have determined that Nikki has reached a plateau and will not likely improve in her speech or hearing abilities. Based on her doctor recommendation along with the advisors at the speech school, we requested Cigna (my employer provided insurance) to cover the cost of the cochlear implant. Cigna denied to cover the implant based on information provided and we appealed.

The initial reason Cigna denied coverage was stated that Nikki’s hearing loss was not significant enough and she had not utilized hearing aids for at least a three-month period. During the appeal Cigna was informed that Nikki had in fact utilized hearing aids in both ears for more than two years, and her deafness was far greater than what Cigna required. Cigna denied our appeal for coverage stating that they felt that Nikki was progressing or could progress with further use of hearing aids. Due to Nikki being immune suppressed it is difficult to keep her healthy long enough to have a surgery, (she has had at least 8 pneumonia infections in the last year and a half). We have her scheduled to receive the implant at the end of July, however without coverage Nikki will not be able to receive the implant.

Nikki is now three years old and has overcome so much adversity in her young life. According to the rules she is “disabled”, but with the cochlear implants that would enable her to hear she would no longer be “disabled”. Change.org was able to assist another family in the same area that we live who were also undergoing the refusal of the insurance company. I work as a police officer and my wife is a lawyer who provides legal services to indigent clients as well as others.

In Georgia it seems that insurance companies do not cover any hearing loss coverage. Nikki’s hearing aids were provided for her when she was eligible for Medicaid under the Katie Beckett waiver, however due to the recent changes in the Medicaid coverage, Nikki is no longer eligible to receive the Katie Beckett waiver. Our family hopes that with the support of this petition Nikki will be able to receive her cochlear implants, and other children and their families will not have to endure the hardships of deafness when there is a potential remedy available.

My understanding of the cost of a cochlear implant is each ear cost about $125,000.00. Nikki, like other kids and adults who receive cochlear implants require intense therapy to “train” their brain to hear again. Based on information cochlear implants are performed on a regular basis with overwhelming success. We want our baby girl and others like her to be able to grow and enjoy life with every opportunity. I would be willing to pay even more than I do for the insurance premium, but how can anyone say that hearing is not medically necessary as was stated by Cigna?

How Keeping a Mood Chart Saved My Life

When I started seeing my Psychopharmacologist almost 16 years ago he intimidated me. He’s not a chipper guy and it took years to see through his shell. I was in a very dark place and spiraling down. I didn’t think he understood how depressed I was. Psychiatrist are different from therapist in how they schedule their time unless your Psych is also your therapist. He only provides medication management, 20 minutes at most. So we had a couple of frustrating meetings. I didn’t know how to reach him, I didn’t know doctor talk. He is one of the best in Texas and finding a Psychopharmacologist is difficult, I wasn’t walking away. During another frustrating meeting he left the room to talk to a therapist he worked with. He did me the biggest favor and no doubt saved my life. I sat down with the therapist expressing my frustration getting thru to him. They had worked together for 13 years, she provided some insight to his personality and how best to communicate with him. She drew a chart and we talked about how depressed I was. She repeated back to make sure she was on track and then gave me the chart. At that time I was rapid cycling, adjusting to meds and didn’t think I was improving. The Mood Chart brought our communication on the same page. I liked the log because it gave me an opportunity to show how I was cycling or any other significant change. I took out a journal and started keep a daily log of the chart and any info about my state of mind. It gave me an opportunity to see exactly what was happening at any give time or day, look for trends, triggers, side effect notes. I wanted to share the chart for those struggling with their mental illness and/or expressing it to the doctor. Once we were on the same page, he was able to give me the help I needed. It’s interesting to go back year after year and look for cycles or triggers. I would suggest a larger sheet of paper to give room for notes. If you have questions let me know. I’m including the definition of Psychopharmacologist. I suffered with my Bipolar Disorder for years until I found the right type of doctor.

Psychopharmacology:  is the scientific study of the effects drugs have on mood, sensation, thinking, and behavior.The field of psychopharmacology studies a wide range of substances with various types of psychoactive properties, focusing primarily on the chemical interactions with the brain.Psychoactive drugs interact with particular target sites or receptors found in the nervous system to induce widespread changes in physiological or psychological functions. The specific interaction between drugs and their receptors is referred to as “drug action”, and the widespread changes in physiological or psychological function is referred to as “drug effect”. These drugs may originate from natural sources such as plants and animals, or from artificial sources such as chemical synthesis in the laboratory.

Let’s keep up the pressure until we know Meriam Yehya Ibrahim is safe and free

The last 48 hours have been a whirlwind of news surrounding the case of Meriam Ibrahim. On Monday, a Sudanese appeals court ruled that she should be set free, and that they charges she was facing — arrested and sentenced to die for not being willing to give up her Christian faith or renounce her marriage to her husband, Daniel — should be voided.

Then on Tuesday, as she went to the airport to leave with her husband and kids, she was held by Sudanese intelligence officials, and we are still waiting to know if she has been able to leave the country.

While this story plays out, we cannot let up on our demand that Meriam be set free and allowed to travel with her husband and her two kids. We are almost at one million signatures. Please, while Meriam’s future still remains uncertain, share this petition with on Facebook, Twitter, or with your friends and family, and keep up the global momentum for Meriam to be free.

With your help we can build more than one million voices calling for Meriam’s freedom. She is so close. Please stand with me once more and show the rest of the world that Meriam should be free and reunited with her family.

Children Restrained or Secluded 267,000 Times School Year*Most Have Disabilities or Mental Illness*

My Two Cents

This a brief update from NAMI, National Alliance Mental Illness. I can’t wrap my head around 267,000 students restrained or secluded, the majority with Disabilities or Mental Illness. It’s not a punishment I can get on board with. The parents are accountable for their children and how they act in school. Do parents have alternative schools? My mind is over flowing with questions. Do schools have a process, is the process monitored, by who, documented, are there defined actions, limitations? Are teachers and principals discussing the process of punishment with parents face to face? Are parents notified before school starts? Is the child involved in meetings to give input and ask questions? What grades are included or all?  How many offences allowed before the child needs to transfer to school capable of meeting their needs. Is a detailed report required for each incident and discussed with parent? Do the disabled students understand why their being punished? Are the disabled students from a different learning environment? Which organization determined this punishment was Best Practices? Are investigations performed by governing organization? I strongly believe parents are accountable for their children which includes providing an appropriate learning environment. The other students deserve a healthy learning environment. I feel like all students lose with this policy and abusive.   Warrior

NPR just wrote an article that highlights the need for immediate action to regulate restraint and seclusion in our nation’s schools. Data from the U.S. Department of Education shows that there were 267,000 instances of restraining or secluding children in schools in one school year.

Some schools reported restraining or secluding students dozens and even hundreds of times each year. In 75 percent of these cases, restraint and seclusion was used with children who have a disability such as mental illness. ​

Contact your Senators and Representatives and ask them to co-sponsor the Keeping All Students Safe Act (S. 2036 and H.R. 1893) which will regulate the use of restraint and seclusion in our nation’s schools and protect children from harm. There are currently no federal laws regulating the use of restraint and seclusion in schools.

Government of Sudan: Don’t execute Meriam Yehya Ibrahim for being Christian #SaveMeriam received 985,603 supporters. 

23 Jun 2014 — Today a Sudanese appeals court ordered Meriam’s release from the prison where for months she’s been awaiting execution for her refusal to renounce her Christian faith. The decision comes after almost a million people from around the world — including you! — signed my petition on Change.org that added to the chorus of international voices demanding justice for Meriam.

Over the past few months world leaders like David Cameron, Prime Minister of the United Kingdom, and John Kerry, the United States Secretary of State, have spoken out against Meriam’s imprisonment, and media coverage of her story has raised an important conversation about religious freedom and women’s rights around the world.

I started my petition after I saw how the #BringBackOurGirls campaign, focused on freeing 276 girls kidnapped in Nigeria, got over a million signatures and launched a global movement that spurred governments to take action. Now, thanks to our voices, a young mother and her children have been freed from prison and the right to religious freedom is a little bit safer.

Over the next few days we will be monitoring reports from Sudan; we cannot let our guard down until we are sure Meriam is home with her family and safe from other threats.

But let today’s events be a message to the rest of the world that we will not stand by and let injustice happen. We’ve proven once again that coming together online can make a real difference toward the goal of human rights for everyone.

Jacob Lavoro is a teenager facing life in prison for baking marijuana brownies in Round Rock, Texas. He’s a young man who has never been in trouble with the law before, and has always been a great kid who we love very much. I live in the same city as Jacob Lavoro and I felt a responsibility to help stand up for him. Our county has a history of excessively punishing minor crimes or even innocent people to “send a message” that has little do with justice or the best interests of the community. In this case, the sentencing rules are being abused and stretched to increase a punishment that does not fit the allegations. The police apparently included the full weight of the brownies: flour, sugar, water, etc and the plastic containers that held them to determine the weight of the illegal hash oil used to bake the brownies. If our petition can convince Jana Duty, the District Attorney in Williamson County, to follow through on her campaign promises to clean up Williamson County’s justice system and offer alternative sentencing options then we hope that there will be justice for Jacob Lavoro and that county residents can breathe easier under a less oppressive atmosphere. If Jacob Lavoro receives a harsh sentence, it will destroy this young man’s life and leave a permanent mark of injustice in Williamson County, Texas. Non-Violent 1st Time Drug Offender Spends *Life in Jail Without Parole*

My name is Heather Minor and on February 6, 2001, when I was 7 years old, my life took a horrible turn when my father was sentenced to life in prison for a nonviolent drug offense. Without clemency from President Obama, he will die in prison.

When my father, Ricky Minor, was given his sentence I didn’t realize I was about to begin a journey that would become a new “normal” way of life for me – growing up without a father. Even though my dad was a first time nonviolent drug offender, under mandatory minimum sentencing laws he was sentenced to life in prison without the possibility of parole. On that same day, my mother was also arrested. My whole world as I knew it was completely destroyed. At the age of seven, both of my parents were taken away from me, and from that point forward I was raised by my elderly grandparents.

I am now 21 years old, the first in my family to graduate from high school, and taking additional classes to improve my life. However, while I am trying to make the best of my life, the realization that my father will die alone in prison is too much for me to fathom. My father was suffering from a drug addiction and trying to cope with it. He was not some “big time” drug dealer, but an addict struggling to support his habit who was a victim of an overly harsh and inflexible mandatory sentencing structure.

Even the sentencing federal judge hesitated to impose the life sentence. As my dad said at his hearing, “rapists, murderers and child molesters will be set free before me…where is the justice in that?”

My dad has now served over 14 years of his sentence – most of it over 700 miles from my home. I have grown from a small child to an adult only seeing him once or twice a year due to limited funds for travel and taxing health issues of my grandparents. The only opportunity I had to form a relationship with my dad was through weekly phone calls and occasional letters. It is heartbreaking.

I just want a chance to get to know my dad like every other daughter. Even though I know and he knows what he did was wrong, I think he has served more than enough to compensate for the crime he committed. He has paid the price of his crimes…but so have I, and I didn’t do anything wrong other than be a victim of parents with a drug addiction. He has completely rehabilitated himself by obtaining his GED, furthering his education, drug free and very health conscious including his diet and physical activities.

Allied Soldiers Arrive 1944 on Shores Of Normandy,France

Thank you to all the Hero’s I’ll never know. Today and everyday I remember America is a free nation because others made sacrifices. Here’s a Texas size hug!

Today is the 70th anniversary of D-Day when more than a 160,000 Allied troops landing on a 50 miles stretch of beaches in Normandy, France. The shores were heavily fortified, over 9,000 were killed or wounded. The sacrifice made by the first men opened the doors for an extra 100,000 plus men to defeat Nazi Germany. We have lost many from this generation, some say the greatest generation. I think war is war and losing one American is too many. I’m not naïve enough to think more American’s are not going to die or wounded in current and future conflicts. As we honor these Hero’s today let’s remember we are a free country because of the sacrifices made since we put foot on this land. Many Veterans feel they have been forgotten, who could blame them after the VA scandal. We don’t know the names of every man and woman who died for us. We’re home in the cozy lazy boy compared to the horrid weather soldiers have endured over the years. When you see a Veteran, go shake their hand and tell then how much appreciate their sacrifice. Because of the sacrifices the Military we are America Home of the Free. We need to let that soak in when we see what’s going on in a large part of the world today. I would like to tell you more about my gramps who is my Hero.

My Gramps An American Hero

Many of you know my gramps means everything to me from previous  post. He was hard-headed, a gentleman, liked dirty jokes, loved a game of 42 and devoted to his family. He married my grandmother when my father was 10 years old. My grandfather was a good-looking man, the bluest eyes, big flirt, great sense of humor, hard-working and above all he was smart. He was 35 years old when they married in 1950, very unusual for a man of that generation. I say he was smart because he joined the Army at 17 years old, upon returning from the war he took his time finding his forever wife. My grandmother was very attractive, even with her crossed eyes, he had choices and my grandmother was his choice.  At 35 years old he knew what he wanted in a wife vs. a girlfriend. He raised my father the same way he raised me. When I got my driver’s licence at 15 years old, he made me pay $50 a year to cover part of the insurance. I also paid $8 a week for gas. That doesn’t sound like much, gas was $0.89 at the time. I was only able to drive to/from work and take granny to the mall. No cruising, no nothing and the rules didn’t change when I got my car at 16 years old. I was writing for our school paper and writing sports for the Irving Daily News, they were on the approved list. He was smart because he knew I drank and if I couldn’t drive on the weekend my risk were reduced. My gramps was the pillar of responsibility. One of his lesson’s, if  you borrow something give it back in better shape. I was so blessed move in with them at 14 years old. I learned so much more than I knew until he was gone. We had so much fun, I think he was the best gramps ever.

We didn’t talk about the war much, they weren’t memories he wanted to relive. A couple of years before his death while looking at discharge papers I saw he had a Bronze Star among other medals. This did not surprise me but you will probably get a kick out of. I said where is your Bronze Star, he walked out to garage and pulled out of his tool box. That was gramps. I asked what he did to get it and he said they gave them to everyone. I knew it wasn’t true but went along. All the Military records for a segment of the alphabet were housed in Kansas City, in the 1970’s the building caught fire and all the records were lost. His paperwork was in the fire. I figured there was a way to get what I needed. I gave her the information on his discharge papers and she sent me a replacement for every medal awarded. I showed him so proudly what I had done, he said what did you that for? The medals could be like memories he didn’t want to remember. I love you gramps.

Senate Appropriations Approves Funding to Address Nation’s Rape Kit Backlog

Senate Appropriations Committee Affirms Longstanding Commitment to Addressing Rape Kit Backlogs

On Thursday, June 5, the Senate Appropriations Committee approved a spending bill that addresses the nation’s rape kit backlog. Central to this effort is the renewal of current funding levels of $117 million to support the Debbie Smith DNA Backlog Grant Program, which supports the testing of backlogged sexual assault forensic exams (rape kits). The bill also establishes and funds a new program to support community-based sexual assault response reform. In April, the House of Representatives also approved level funding for the proven Debbie Smith Act and provided an additional $35 million in support of efforts to address backlogs of sexual assault kits at law enforcement agencies.

RAINN, together with allied organizations and individuals including the National Center for Victims of Crime, Debbie Smith of H-E-A-R-T, Inc, the National Alliance Against Sexual Violence, Parents of Murdered Children, Ed Smart of the Surviving Parents Coalition, DNA Saves, and the International Association of Forensic Nurses, has expressed support for continued funding of the Debbie Smith Act and complementary efforts that will help to remove serial criminals from our streets and enhance public safety.

The full Senate is expected to consider the spending measure, which also supports a number of other programs and initiatives designed to support victims of sexual violence and hold perpetrators accountable, in the coming weeks. The differences between the House and Senate-approved spending plans must then be reconciled.

This morning, the Senate Appropriations Committee approved $41 million in its FY2015 Commerce, Justice and Science spending bill to address the rape kit backlog. The Senate’s actions follow on the heels of last week’s vote by the House of Representatives for this historic level of funding in its new spending bill. The new program will provide communities with the vital resources they need to help end the backlog at law enforcement agencies throughout the country, with a focus on investigating cases and re-engaging survivors in the process.

As we begin the final push to ensure this funding is passed by the full Senate, we urge you to join the thousands who have already taken action and made their voices heard.Write to your Senators and urge them to support this funding as the bill moves through the Senate. Translators for US Military in Afghan and Iraqi Face Taliban Kill List

Join me in supporting a critical visa program to save the lives of interpreters in Afghanistan who have helped US troops like me. In 2008, I was serving as an Embedded Combat Adviser in Afghanistan when my interpreter, Janis Shinwari, and I were caught in the middle of a firefight. He took swift action when a combatant shot at me and saved my life. But beyond that specific incident, Janis served a critical role for me and all the other troops serving in Afghanistan. Thousands of Afghan nationals like Janis have served as interpreters to assist US troops in communicating in real-time and providing a cultural link between the troops and Afghan nationals.

But like Janis, many of these interpreters find their lives at risk for their work with US troops. Janis was placed on a Taliban kill list and had to go into hiding with his family. Thankfully, legislation passed in 2009 (the Afghan Allies Protection Act) created a Special Immigrant Visa (SIV) program to help these interpreters escape to safety in the US. Janis and I learned the hard way that the program had a number of flaws.

It took years — and Change.org petition — to help Janis finally secure his visa. Thankfully, Janis and his family have resettled in the US. Since then, we’ve started an organization to help resettle Afghan and Iraqi translators called No One Left Behind and since January we’ve helped resettle 10 Afghan families all over the US with MANY more to come.

With the visa program set to expire, this crucial program that saves the lives of dedicated interpreters who gave up so much in service of our troops could close. Senators McCain and Shaheen and Representatives Blumenauer and Kinzinger have introduced a new bill — the Afghan Allies Protection Extension Act — that will not only extend this visa program but also strengthen it to make it an even better program.

Where Do You Turn When Teacher is Bullying

This is a repost from 2014, the point is schools have gone from sending notes about children being overweight to lunch shaming. I look back at my childhood, kids were bullied by other kids if they had a lunch coupon. I didn’t understand the problem then and certainly find it unacceptable this is happening by school staff today.

The mother of a third-grade girl says she’s upset that the city Department of Education sent home a health assessment in her daughter’s book bag that categorizes the 9-year-old as “overweight.” Roseanne Colletti reports. Each year, 870,000 New York City public school students in kindergarten through grade 12 are handed their Fitnessgram assessments and told to bring them home without peeking inside.

Laura Bruij Williams says her daughter, Gwendolyn Williams, looked at hers, and asked her about it one night while getting ready for bed at their Staten Island home. Gwendolyn is 4 feet 1 inch tall and weighs 66 pounds.
The analysis said her Body Mass Index is “overweight.” “She said ‘Mom, school told me that I’m overweight,'” Williams told NBC 4 New York. “I was very angry and upset because I don’t want this to be the kind of thing that sticks with her.”

The Department of Education says the assessments are “based on whether an individual student is in the Healthy Fitness Zone for their age and sex.” They are supposed to be sealed and given to parents only, so that the adults can start conversations with their kids about good eating habits and exercise. Williams, who says her daughter is active and healthy, said she would have preferred the assessment be given directly to parents so that children aren’t even tempted to look. She said a friend of Gwendolyn’s was in tears about her assessment. “I think they should be sent to parents, mailed home or have them finished for conferences,” Williams said.

 

Sometimes we think magazines and media portraying extremely thin girls and women result in body image issues. I have not seen any studies yet know first hand how it feels to have a warped sense of your body. I had unhealthy body image issues by fifth grade and dreaded P.E. class. I was probably 10 pounds under weight but wanted to look like my Farrah poster. I would not take part in sports because I imagined how fat I looked in the short shorts running track or playing basketball. I think most teacher’s understand the pressure on all kids today. This school and Teacher became part of the problem. Talk to the school Principle and Teacher to discuss their process for communicating with parents. If you feel the process it lacking or potentially harmful to your child let them know. Then write a letter to School Board addressing concerns. I would be the soft-spoken mother who loses it, the school is bullying the kids and parents. The scars on the kids that can last a lifetime. Not all parents would recognize weight issues that young and could miss an opportunity to save their kids and themselves much grief. You pay taxes for your child’s education, speak up and hold school accountable.
